Welcome to Home Service Bros ("Company," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our website, services, and platform (collectively, the "Platform"). By accessing or using our Platform, you agree to be bound by these Terms.

2. Nature of Our Service

Home Service Bros operates as a marketplace platform that connects homeowners with independent service professionals ("Contractors" or "Pros"). We are not a contractor, home improvement company, or service provider. We do not employ the Contractors who perform services arranged through our Platform.

All services, including but not limited to permanent light installation, holiday lighting, and other home services, are performed by independent Contractors who are solely responsible for the quality, safety, and completion of their work.

3. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOME SERVICE BROS SHALL NOT BE LIABLE FOR:

• Any work, installations, repairs, or services performed by Contractors
• Any property damage, personal injury, or other harm arising from services arranged through our Platform
• Any disputes between users and Contractors
• The conduct, actions, or inactions of any Contractor or service professional
• Any warranties, representations, or guarantees made by Contractors
• The quality, safety, legality, or any other aspect of services provided by Contractors
• Any failure by Contractors to complete work, meet schedules, or fulfill obligations

4. Independent Contractor Relationship

All Contractors and Pros accessible through our Platform are independent contractors and are not employees, agents, joint venturers, or partners of Home Service Bros. We do not control, and are not responsible for, the manner or method by which Contractors perform their services.

While we may perform background checks or verify certain credentials, such screening does not constitute an endorsement, guarantee, or warranty of any Contractor's qualifications, reliability, or quality of work.

5. User Responsibilities

By using our Platform, you agree to:

• Provide accurate and complete information when requesting quotes or services
• Communicate directly with Contractors regarding project details, timelines, and expectations
• Review and understand any contracts or agreements with Contractors before accepting
• Pay Contractors according to agreed-upon terms
• Obtain any necessary permits or approvals required for your project

6. Quotes and Pricing

Quotes provided through our Platform are estimates based on information provided by you. Final pricing may vary based on actual project scope, conditions discovered during work, and other factors. By accepting a quote, you are entering into an agreement with the Contractor, not with Home Service Bros.

7. Dispute Resolution

Any disputes arising from services performed by Contractors should be resolved directly between you and the Contractor. While we may attempt to facilitate communication between parties, we are not obligated to mediate or resolve disputes, and any such assistance is provided as a courtesy only.

8. Indemnification

You agree to indemnify, defend, and hold harmless Home Service Bros, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from your use of the Platform, your interaction with Contractors, or your violation of these Terms.

9. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

10. Insurance and Licensing

Contractors are responsible for maintaining appropriate insurance coverage and licenses required by applicable law. We encourage users to verify that Contractors carry adequate insurance before work begins. Home Service Bros does not provide insurance coverage for work performed by Contractors.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our Platform with a new "Last Updated" date. Your continued use of the Platform after such changes constitutes acceptance of the modified Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions. Any legal action arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in New Jersey.
